Protection of press photographs
Courts often deny photojournalists the existence of free and creative choices, thereby depriving them of copyright protection. However, case law does allow for originality, particularly when the photojournalist has set the scene for his or her subject. It also accepts that the originality of the moment captured can confer sufficient creativity to a photograph. In the absence of copyright protection, the photojournalist can sue for civil liability.
